Terms of Service
Hemp.Net sells access to our computer network on a subscription basis. As an account holder at Hemp.Net in good standing, you receive the privilege of making a dialup or telnet connection with a valid login ID and password. You also receive the right to send and receive packets across our dedicated connection to the Internet.

Your account is intended for your personal use only. You are not to give your login and password to others for their use. You are not permitted to be logged on to more than one dialup port at any given time without prior consent from Hemp.Net. You are not permitted to run applications designed to maintain an open line while you are not using the service. Violation of these terms can be grounds for suspension or cessation of service.

Hemp.Net makes every effort to keep the system available at all times. However, due to the nature of providing internet services, we are unable to guarantee 100% uptime. We strive at all times to inform our members of scheduled maintenance with as much advance notice as possible. On rare occasions, unscheduled maintenance may be necessary, and members should be prepared to be logged off for brief periods on very short notice. Scheduled maintenance will be performed during off-peak, late night, and weekend hours whenever possible.

Member Identity

Users must provide their real names, addresses, and other relevant identifying information when opening an Hemp.Net account. After you open your account, you may adopt a different name for online activities.

Security

Accessing, or attempting to access, Hemp.Net's system files, or any private files belonging to another user without advance written permission from the other user and advance written notice to Hemp.Net will lead to the immediate termination of your account. If Hemp.Net finds that any files or processes belonging to a user otherwise threaten Hemp.Net's security, Hemp.Net will immediately delete those files, stop the processes, and/or terminate the user's account.

Since the security and reliable operation of Hemp.Net is important to everyone, Hemp.Net reserves the right to take whatever actions necessary to preserve the security and reliability of the system, including closing the accounts of users who hamper the security and reliability of the system. Hemp.Net attempts to keep the system as secure as possible, but cannot guarantee absolute and continuous privacy of users' files.

Illegal Activity

Any illegal activity under the laws of the State of Washington and the United States which is conducted through use of an Hemp.Net account is a violation of the terms of the account with Hemp.Net. Members should also be aware that Hemp.Net is open to users worldwide. Please consider the possible effects of laws outside Hemp.Net's locality and users' own residences when using an Hemp.Net account to engage in activities that involve other states or countries.

Hemp.Net reserves the right to refuse service to any person, and to close an account at any time.

Abuse of Internet Email ("spam")

We explicitly prohibit the posting of junk email to Usenet newsgroups, mailing lists and to the electronic mail accounts of those who did not request the information. Junk email is defined as unsolicited commercial email.

We encourage organizations with Hemp.Net accounts to advertise, and are happy to provide space for web sites. But we do not support, condone or allow junk emailings and Usenet postings. While it is not legal for Hemp.Net to monitor our members' electronic mail, if we receive complaints regarding a Hemp.Net subscriber's junk mailing or Usenet spam, we must take appropriate action to prevent further activities from taking place. We cooperate with other conferencing systems and Internet Service Providers to stop spamming.

Billing

Hemp.Net bills for access, not for usage. Accounts are billed the day they are established, and must be paid within 15 days. All invoices are sent out through e-mail. All charges that accrue to a user's account are payable upon receipt of the invoice and must be paid within 15 days.

A Late Charge of 1.5% per month will be assessed to all bills 15 days old or older. Members who do not pay within 45 days will have their accounts suspended until payment is received. Suspended accounts will be reactivated intact upon receipt of payment.

Hemp.Net does not yet take credit cards. Make checks payable to Hemp.Net and mail to 7744 29th Ave NW, Seattle, WA 98117. There is a $25 service charge for returned checks.

Billing will continue until the account is closed by the member. To close your account, telephone Hemp.Net at 206-781-8307 or send email to support@hemp.net.

Referral Policy

We at Hemp.Net are proud to have so many satisfied customers, and we want to reward those who spread the word. As a Thank-You for referring new accounts to us, we will credit your account an amount equal to the value of the monthly service that your referral chooses.

For example, if you refer a new "Remote Access" account to us, your account will be credited for $10. If you refer a Dialup Account your account will be credited $20. Credit will be applied upon payment of the new account holder's first invoice. Refer a new account a month and get your account absolutely free!

Credit Card Policy

We accept Mastercard and Visa for payment. As our services will be provided immediately after your credit card has been approved there are no refunds on credit card purchases. Indemnification

Members agree that they shall defend, indemnify, save and hold Hemp.Net harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Hemp.Net, its agents, its members, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by a member, its agents, employees or assigns.

Members agree to defend, indemnify and hold harmless Hemp.Net against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Hemp.Net's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Hemp.Net server.

Disclaimer

Hemp.Net will not be responsible for any damages members may suffer. Hemp.Net makes no warranties of any kind, expressed or implied for services we provide. Hemp.Net disclaims any warranty of merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Hemp.Net and its employees. Hemp.Net reserves the right to revise these policies at any time.

Display of Policies

These policies and terms of service will remain available at all times for review on the Hemp.Net web site at http://www.hemp.net/guide/tos.html. If Hemp.Net makes any changes to its policies or terms of service, there will be an announcement to all Hemp.Net users and changes may become effective immediately.
